These terms apply when you use surgesoftware.co.in or any product that Surge Software Solutions Pvt Ltd ("Surge", "we") runs on its own website and links from our products page. By creating an account or using a product, you agree to them. If you use a product for a company, you confirm you may accept these terms for it.
A product may have extra terms for that product (for example a professional-use notice). Those add to these terms. How we handle personal data is in our privacy policy.
The products are free to use while we launch them. Some optional features use outside services that charge per use, such as premium AI or voice engines, phone minutes, messages or data look-ups. If you switch one on, you pay exactly what that service costs us, with no markup, from a prepaid balance you add through Razorpay. Each product's pricing page lists these add-ons.
We may introduce paid plans later. We will tell account holders in advance, and nothing is charged without your action. Unused prepaid balance is refundable on request at any time; see our cancellation and refund policy.
You must not use the products to:
Some products that send messages on your behalf review new accounts before sending is switched on. We may suspend an account that breaks these rules.
You keep all rights in what you upload and in the results you create. You give us permission to store and process it only to run the product for you. You are responsible for having the right to upload it, including any personal data of other people (such as your customers, candidates or patients). Where you process their data in a product, you are the data fiduciary and we process it for you.
AI can be wrong. Check results before you rely on them or send them to others. You decide what to publish, send or act on.
We work to keep the products running, but they are provided "as is" and may change, pause or have downtime. Some features are marked "coming soon" or "preview" and may not work fully. We may change or retire a product; if we retire one, we will give reasonable notice and a way to export your data.
To the extent the law allows, Surge is not liable for indirect or consequential loss, such as lost profit, revenue or data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
You can stop using a product and close your account at any time from its settings or by emailing corp@surgesoftware.co.in. We may suspend or close an account that breaks these terms or the law, and will tell you why unless the law prevents it.
These terms are governed by the laws of India, and the courts of Bengaluru, Karnataka have jurisdiction. If we change these terms, we will update the date above and tell account holders of important changes by email.
